Terms & Conditions

Version 1.0 — Last updated May 2026

Governed by the Laws of England and Wales · Gambling Act 2005 Compliant

IMPORTANT NOTICE:These Terms and Conditions constitute a legally binding agreement between you (the “Entrant”) and The GenAI Engineer (“TGAI”, “we”, “us”, “our”). By submitting an entry and/or participating in The GenAI Engineer Prize Draw (the “Prize Draw”), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree, please do not participate.

1. The Organiser

The Prize Draw is organised by The GenAI Engineer (“TGAI”), a community community for AI engineers, builders, and practitioners in the United Kingdom. Enquiries relating to the Prize Draw must be directed exclusively to:

Email: prizedraw@thegenaiengineer.com

No enquiries will be acknowledged or acted upon if sent to any other address or via any WhatsApp group or personal message.

2. Legal Framework and Classification

2.1 The Prize Draw is operated as a Prize Competition within the meaning of section 14 of the Gambling Act 2005, by virtue of the inclusion of a mandatory skill-based question that must be correctly answered by all Entrants as a condition of valid entry. Success in the Prize Draw requires an element of skill and is therefore not classified as a lottery under the Act.

2.2The Prize Draw is intended solely for community participation within TGAI’s membership groups. It is not operated for commercial gain. TGAI reserves the right to cancel, suspend, or modify the Prize Draw at any time where required to maintain lawful compliance.

2.3 Nothing in these Terms and Conditions is intended to override or conflict with applicable UK legislation, including but not limited to the Gambling Act 2005, the Consumer Rights Act 2015, or the Unfair Terms in Consumer Contracts Regulations.

3. Eligibility to Enter

3.1 Entry is strictly limited to individuals who meet ALL of the following criteria at the time of entry and at the date of the draw:

  • Must be aged 18 years or over. Proof of age may be requested at any stage.
  • Must be an active member of an official AI Engineering Community WhatsApp group at the time of entry and at the date of the draw.
  • Must have correctly answered the mandatory skill question (see Clause 5).
  • Must have made full and verified payment prior to entry confirmation.

3.2 Membership of the above WhatsApp groups will be verified by TGAI administrators. Any individual found to be ineligible — whether at the time of entry or prior to the draw — shall have their entries cancelled and shall not be entitled to any prize.

WARNING: UNDER-18 PARTICIPATION IS STRICTLY PROHIBITED. Any entry submitted by or on behalf of a person under the age of 18 will be void and cancelled without refund.

4. Entry Fee and Limits

4.1 Each entry is priced as displayed on the Prize Draw page (the entry fee may vary between draws).

4.2 Each Entrant may submit a maximum number of entries per Prize Draw, regardless of the number of WhatsApp groups in which they are a member. Entries submitted in excess of this limit will be cancelled and refunded in accordance with Clause 11.

4.3 Entries are personal to the Entrant and are non-transferable. The sale, transfer, assignment, or gifting of entries to any third party is not permitted.

4.4 Entries will only be confirmed following receipt and verification of payment in full. Partial payments will not result in entry confirmation.

5. Mandatory Skill Question

5.1In accordance with section 14 of the Gambling Act 2005, all Entrants must correctly answer a skill-based question as a condition of valid entry. The skill question is presented to Entrants on The GenAI Engineer website (the “Portal”) at the time of entry. A different question is randomly selected from TGAI’s curated question pool for each entry attempt.

5.2 Any entry submitted with an incorrect answer to the skill question will be deemed invalid and the Entrant will be invited to attempt a new randomly selected question. No entry will be created until a correct answer has been submitted.

5.3TGAI’s determination as to whether an answer to the skill question is correct shall be final and binding.

5.4 The purpose of the skill question is to ensure the Prize Draw is operated lawfully as a prize competition. TGAI takes this requirement seriously and it will be strictly enforced.

6. Payment and Entry Confirmation

6.1 Payment may be made via either of the following methods, both available on the Portal:

  • Pay by Bank (instant online payment):Entrants are redirected to their bank’s app or website to authorise payment via the UK Open Banking / Faster Payments system. Payment is processed by Stripe Payments UK, Ltd. on TGAI’s behalf. Entries are confirmed automatically upon successful payment.
  • Manual bank transfer:Entrants are presented with TGAI’s bank details and a unique payment reference on the entry confirmation page. Payment must be made using the supplied reference. Entries are confirmed manually by a TGAI administrator after the payment has cleared and been reconciled.

6.2 The number of entries confirmed for any Entrant shall correspond strictly to the verified payment received, calculated at £5.00 per entry. Where payment received does not match the number of entries requested:

  • Entries will be confirmed only up to the value of the payment received.
  • TGAI will not accept any additional payment once the sale period has closed.
  • Late payments will not be accepted under any circumstances.

WARNING:If your payment does not reach us before the announced closing date, your entry will not be valid. It is the Entrant’s sole responsibility to ensure timely and accurate payment.

6.3 TGAI accepts no responsibility for delays, failures, or errors caused by any banking institution, payment processor, or Open Banking provider. Entrants are advised to allow sufficient time for payments to clear prior to the closing date.

6.4 The Portal automatically generates a unique payment reference for each entry. Entrants paying by manual bank transfer must include this reference exactly as displayed to enable identification of the payment. Entrants paying via Pay by Bank do not need to enter a reference manually — it is included automatically by the system.

7. Entry Period and Draw Date

7.1The opening date for entries (“Opening Date”), the closing date for entries (“Closing Date”), and the date of the draw (“Draw Date”) will be announced via the Portal and the official AI Engineering Community WhatsApp groups listed in Clause 3.1. Announcements will be posted at the commencement of each Prize Draw cycle.

7.2TGAI shall not be responsible for communicating dates via any other channel, platform, or medium. It is the Entrant’s responsibility to monitor the Portal and the relevant WhatsApp group for announcements.

7.3 Entries received after the Closing Date will not be accepted. Payments received after the Closing Date will not result in entry confirmation.

8. The Draw

8.1 The draw will be conducted using the Prize Draw Portal. The Portal will randomly select the winning entries using a cryptographically secure random number generator (CSPRNG), giving each confirmed entry an equal chance of selection per unit purchased.

8.2 The draw will take place on or around the announced Draw Date, visualised through a Wheel of Fortune at a The GenAI Engineer community event. TGAI reserves the right to postpone the draw if necessary, in which case an updated Draw Date will be communicated via the Portal and the official AI Engineering Community WhatsApp groups.

8.3 The draw result shall be final and binding. No correspondence will be entered into regarding the outcome of the draw.

8.4 Winners will be notified via the contact details provided at the time of entry and/or via the AI Engineering Community WhatsApp groups.

9. Prizes

9.1 The total prize pot for each Prize Draw is the total amount received from confirmed entries, less any reasonable expenses incurred by TGAI (including but not limited to payment processing fees and administrative costs). The prize pot will be distributed as follows:

  • First Prize: 50% of the prize pot
  • Second Prize: 25% of the prize pot
  • The GenAI Engineer community Activities: 25% of the prize pot

9.2 The Second Prize winner is drawn first, then excluded from the First Prize draw — no Entrant may win both prizes from a single Prize Draw.

9.3 If fewer than two participants have submitted confirmed entries, the full prize pot (after expenses) will be awarded as a single prize.

9.4 Prizes are non-transferable and cannot be exchanged for cash or any alternative prize unless TGAI expressly agrees otherwise in writing. Prize amounts are calculated on the entries confirmed at the Closing Date and are rounded down to the nearest penny.

9.5 If a winner cannot be contacted, does not respond within 14 calendar days of the first notification attempt, or is found to be ineligible, TGAI reserves the right to re-draw and award the prize to an alternative valid Entrant.

10. Ineligible Entries and Cancellation

10.1 The following entries will be automatically cancelled and rendered void:

  • Entries from persons not meeting the eligibility criteria in Clause 3.
  • Entries from persons not active members of any AI Engineering Community WhatsApp group listed in Clause 3.1.
  • Entries where the skill question has not been correctly answered.
  • Entries where payment has not been received in full before the Closing Date.
  • Entries made in excess of the maximum entry limit (Clause 4.2).
  • Entries from persons aged under 18.

10.2 TGAI reserves the right to disqualify any Entrant who is found to have provided false or misleading information, acted in bad faith, or otherwise breached these Terms and Conditions. Disqualified entries are not eligible for a refund — see Clause 11.

11. Refunds

11.1 Refunds will only be processed in the following circumstances:

  • Entries are cancelled by TGAI due to Entrant ineligibility under Clause 10.1.
  • The Prize Draw is cancelled by TGAI prior to the Draw Date.
  • Payment received exceeds the value of the maximum permitted entries.

11.2All refunds will be net of any reasonable administrative and processing expenses incurred by TGAI (“Expenses”). Expenses may include, but are not limited to, bank transfer fees, payment processing fees (e.g. Stripe fees, which are not recoverable on refund), administrative costs, and Portal charges.

11.3 Refunds will normally be processed only after the Closing Date has passed and before the Draw Date. No refunds will be processed after the draw has taken place.

11.4Refunds will be made to the original bank account or payment method from which payment was received. TGAI accepts no responsibility for delays caused by the Entrant’s bank or payment provider.

11.5 No refunds will be given to Entrants who voluntarily withdraw from the Prize Draw after the Closing Date.

11.6 Disqualified entries (under Clause 10.2) are not eligible for a refund. The payment is retained.

WARNING: Refunds will be issued minus any expenses incurred by TGAI. The exact deduction will be communicated to the Entrant at the time of refund.

12. Excluded Persons

The following persons are excluded from participating in the Prize Draw:

  • Members of the TGAI organising committee directly responsible for administering the Prize Draw.
  • Immediate family members (spouse, civil partner, parent, sibling, or child) of any such organising committee member.
  • Any person outside of the qualifying AI Engineering Community WhatsApp groups listed in Clause 3.1.

13. Data Protection and Privacy

13.1 Personal data collected in connection with the Prize Draw (including name, contact details, and payment information) will be processed by TGAI solely for the purposes of administering the Prize Draw, verifying eligibility, communicating results, and processing payments and refunds.

13.2 TGAI will handle all personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Data will not be shared with third parties except where required by law or essential to Prize Draw administration (e.g. payment processors). Full details are set out in our Privacy Policy.

13.3 By participating, Entrants consent to their name being shared within the AI Engineering Community groups for the purpose of announcing the draw result.

14. Limitation of Liability

14.1 To the fullest extent permitted by law, TGAI shall not be liable for:

  • Any failure of payment to reach TGAI due to banking errors, payment processor failures, or delays.
  • Any technical failure of the Portal, Stripe, Open Banking providers, or any digital platform used in connection with the Prize Draw.
  • Any loss or damage arising from an Entrant’s failure to comply with these Terms and Conditions.
  • Any indirect, consequential, or economic loss suffered by any Entrant.

14.2Nothing in these Terms and Conditions limits TGAI’s liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

15. General Provisions

15.1 These Terms and Conditions, together with any documents referred to herein, constitute the entire agreement between the Entrant and TGAI in respect of the Prize Draw.

15.2 TGAI reserves the right to amend these Terms and Conditions at any time. Any amendments will be communicated via the Portal and the official AI Engineering Community WhatsApp groups.

15.3TGAI’s decision on all matters relating to the Prize Draw (including eligibility, skill question answers, and draw results) is final and binding.

15.4 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

15.5 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising in connection with the Prize Draw shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.6 The Prize Draw is not sponsored, endorsed, or administered by WhatsApp or Meta Platforms Inc. Any dispute or claim in connection with the Prize Draw must be directed to TGAI and not to WhatsApp or Meta Platforms Inc.
